STATEMENT FROM THE JUDICIAL CONDUCT INVESTIGATIONS OFFICE

Mr Jonathan Sim JP

A spokesperson for the Judicial Conduct Investigations Office said:

The Lord Chancellor, with the agreement of the Lady Chief Justice, has removed Jonathan Sim JP of the North Essex Bench from office for failing, without reasonable excuse, to complete the compulsory core training required of a magistrate.

Facts

The Guide to Judicial Conduct requires judicial officeholders to display diligence and care in the discharge of judicial duties. In addition, magistrates are required, upon appointment, to sign a Declaration and Undertaking confirming that they will complete all compulsory core training and to resign if they fail to do so within the specified timeframe, without an acceptable reason. Magistrates are also expected to keep in regular contact with their Bench Chair.

Mr Sim was referred to the South-East Region Conduct Advisory Committee regarding his failure to complete compulsory core training, and a failure to adequately engage with his Bench Chair’s attempts to contact him to arrange that training.

Mr Sim’s representations

Mr Sim accepted that he had failed to complete the required training and to maintain contact with his Bench Chair. He attributed these failures to a combination of personal and professional circumstances.

Nominated committee’s findings and recommendation

Following an investigation under the Judicial Conduct (Magistrates) Rules 2023, a nominated committee member of the South-East Conduct Advisory Committee found that Mr Sim had failed to complete compulsory training within the required timeframe and had failed to engage with relevant communications, contrary to the standards of diligence and care expected of a magistrate.

The nominated committee member concluded that the conduct amounted to gross misconduct, was not sufficiently mitigated by his explanations, and justified removal from office.

Disciplinary panel’s findings and recommendation

Mr Sim exercised his right under the Rules to have a disciplinary panel consider the case before a final decision was made.

The disciplinary panel found that Mr Sim’s failure to complete essential training, together with his sustained lack of engagement, amounted to gross misconduct. The panel recommended Mr Sim’s removal from office.

Decision

After careful consideration, the Lord Chancellor and the Lady Chief Justice agreed that Mr Sim had failed, without reasonable excuse, to meet the compulsory training requirements of his role, and failed to display diligence and care in the discharge of his judicial duties. They accepted the recommendation that Mr Sim be removed from office.
