STATEMENT FROM THE JUDICIAL CONDUCT

A spokesperson for the Judicial Conduct Investigations Office said:

Mr Justice Keehan, on behalf of the Lady Chief Justice and with the Lord Chancellor’s agreement, has issued Mr Alfred Bean JP of the Cheshire Bench with formal advice for misconduct.

Facts

On appointment, magistrates sign a declaration and undertaking, which includes a commitment to maintain the dignity, standing and good reputation of the magistracy. The Guide to Judicial Conduct reminds office holders to be courteous, patient, tolerant and to respect the dignity of all.

Two complaints were made by members of court staff about interactions they had with Mr Bean after he had encountered difficulties parking at court one morning. One reported that Mr Bean had interrupted a court session to complain about the lack of parking in a loud, rude and bullying manner. The other described being subject to an aggressive rant by Mr Bean, in which he spoke over them in a raised voice. Both reported Mr Bean stating he would leave court if the issue occurred again in future.

Mr Bean’s representations

In his response, Mr Bean explained the stress caused by the parking situation, as well as his personal circumstances. He denied shouting or being aggressive but admitted his voice may have been slightly raised due to his stress and frustration. He also explained that he was unaware the court session had begun. He expressed regret about his behaviour, which had fallen below his usual standards, and stated that he did not intend to be rude or disrespectful. He added that he had attempted to apologise soon after but was told not to contact the complainants. He highlighted his 12-year unblemished conduct record and ongoing commitment to his role as a magistrate.

Nominated Committee Member’s findings

The complaints were considered by a nominated committee member of the North-West Region Conduct Advisory Committee in accordance with the Judicial Conduct (Magistrates) Rules 2023. The nominated committee member found that Mr Bean was not sufficiently circumspect in his conduct and should have remained calm and professional, despite his frustration. She found that interrupting a court session, albeit unintentionally, and ranting at staff in a raised voice, was unacceptable. This amounted to misconduct.

In recommending formal advice, the nominated committee member considered that Mr Bean’s actions were not deliberate, and that he quickly recognised his error and attempted to apologise and take responsibility. She also acknowledged his 12-year record of good service as a magistrate.

Decision

Having considered the mitigation offered by Mr Bean, Mr Justice Keehan and the Lord Chancellor agreed with the nominated committee member’s recommendation.
