Date: 30 June 2026
A spokesperson for the Judicial Conduct Investigations Office said:
The Lord Chancellor, with the Lady Chief Justice’s, agreement, has removed Mr Adam Burkutally of the Birmingham & Solihull Local Justice Area from office for failing to complete his required induction training following his appointment as a magistrate.
Facts
On appointment, magistrates sign a declaration and undertaking which includes a commitment to complete all essential and compulsory training. Where a magistrate fails to do so without an acceptable reason, they are expected to resign.
The summary process in the Judicial Conduct (Magistrates) Rules 2023 allows a conduct advisory committee to recommend removal from office without further investigation where a magistrate has failed, without a reasonable excuse, to complete all essential and compulsory training.
Mr Burkutally was appointed to the magistracy in February 2024. He has not completed any of his induction training since his appointment despite numerous attempts to contact him.
Mr Burkutally’s representations
Mr Burkutally did not respond to the Midlands Conduct Advisory Committee’s request for comments.
Decision
After careful consideration, the Lord Chancellor and the Lady Chief Justice agreed with the recommendation to remove Mr Burkutally from office.
Sanctions for misconduct by judicial office-holders are set out in the Constitutional Reform Act 2005. They are, in order of severity: formal advice, formal warning, reprimand and removal from office.
